Terms and Conditions

1. Eligibility and Accounts

• You must be at least 18 years old or the age of majority in your jurisdiction to use Ajasa.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity under your account.
• You must provide accurate information and keep it up to date.

2. Permitted and Prohibited Use

You agree to use the Platform only for lawful purposes. You must not:

• Use the Platform to infringe intellectual property, privacy, or other rights.
• Upload content you do not have rights to use.
• Impersonate another person or misrepresent authority or identity.
• Attempt to disrupt, reverse engineer, probe, or bypass platform security.
• Use the Platform to create, promote, or distribute unlawful or abusive content.

3. User Content and Voice Permissions

You retain ownership of content you submit, including prompts, lyrics, audio, and voice samples, subject to the rights you grant below.

You grant Ajasa a non-exclusive, worldwide, royalty-free license to host, process, reproduce, modify, and transmit your content solely to operate, secure, and improve the Platform and to provide the outputs you request.

If you submit voice recordings, you represent that you have all required rights and consents to use that voice for generation and processing on the Platform.

4. AI-Generated Output

Ajasa provides AI-generated creative output. Output may vary and may not be unique across all users or providers.

You are responsible for reviewing and validating output before use, publication, or distribution, including checking legal and rights-related compliance for your intended use.

5. Song Ownership and Permitted Use by Tier

Upon confirmed payment, Ajasa grants you a limited, non-exclusive, worldwide, perpetual license to use the AI-generated song ("Song") produced for your order, subject to the tier purchased as set out below. This license is personal to you and is not transferable except where expressly stated.

5.1 Standard Tier — Personal Use License

A Standard tier purchase grants you a personal, non-commercial license to:

• Stream, download, and keep the Song in MP3 format.
• Share the Song privately — for example as a gift, in personal messages, or on personal social media profiles — provided no revenue is earned from that sharing.
• Play the Song at private, non-ticketed events (e.g. a birthday party or wedding reception for personal guests).

Standard tier does not permit commercial use of any kind. See clause 5.4 for the definition of commercial use.

5.2 Premium Tier — Personal Use License with Stems

A Premium tier purchase grants everything included in the Standard tier, plus:

• A WAV-format download of the Song and available stems (instrument/vocal separations).
• The right to edit, remix, or arrange the Song for personal, non-commercial projects.
• Use in non-monetised personal content — for example, a non-monetised personal YouTube video or podcast episode.

Premium tier does not include commercial use rights.

5.3 Ultra Tier — Commercial License

An Ultra tier purchase grants everything included in Premium, plus a full commercial license to:

• Use the Song in advertising, branded content, promotional videos, and marketing campaigns.
• Synchronise the Song with film, television, video games, podcasts, or other media intended for commercial release.
• Use the Song in monetised online content (e.g. YouTube channels with monetisation enabled, paid streaming platforms).
• Use the Song in or alongside a product or service that is sold or licensed to third parties.
• Perform the Song publicly at ticketed or revenue-generating events.
• Sub-license the Song to clients or collaborators as part of a project for which you have been engaged, provided such sub-license does not exceed the scope of this license.

5.4 Definition of Commercial Use

"Commercial use" means any use of the Song that is intended to generate, directly or indirectly, revenue, economic benefit, or professional advantage for you or a third party. This includes but is not limited to: advertising, sponsorship, sale, licensing, monetised streaming or video, use in a product or service offered for payment, and public performance at fee-charging events.

5.5 What All Tiers Share

• No exclusivity. Ajasa does not guarantee that your Song is unique. The AI system may produce similar results for other users. No tier grants an exclusive right to the Song.
• No copyright claim over AI output. In jurisdictions where copyright in AI-generated works does not vest in a human commissioner without creative contribution, you acknowledge that the Song may not qualify for copyright protection. You are responsible for understanding the copyright law in your jurisdiction.
• Attribution. Where reasonably practical, we encourage you to credit "Created with Ajasa" when sharing your Song publicly, but this is not a legal requirement under any tier.
• No offensive use. Regardless of tier, you may not use the Song in connection with hate speech, defamation, harassment, or content that violates applicable law.
• License validity. Your license is valid upon confirmed payment and remains effective unless terminated under clause 7 (Suspension and Termination) or applicable law.

6. Pricing, Billing, and Refunds

• Pricing is shown in-app and on our pricing page. Prices are quoted in Nigerian Naira (NGN) and displayed in your local currency for reference.
• You authorise Ajasa and its payment processors to charge applicable fees. Payments are processed in NGN via Paystack.
• Unless required by law, fees are non-refundable after song generation begins.
• We may change pricing prospectively with notice where required.

7. Intellectual Property

The Platform's software, brand elements, and service content (excluding your content) are owned by Ajasa or its licensors and protected by applicable intellectual property laws.

You may not copy, distribute, modify, or create derivative works from the Platform except as expressly allowed by these Terms or applicable law.

8. Suspension and Termination

We may suspend or terminate access if you violate these Terms, create legal or security risk, or misuse the Platform. You may stop using the Platform at any time.

9. Disclaimers

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Ajasa disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

10. Limitation of Liability

To the maximum extent permitted by law, Ajasa and its affiliates are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, data, revenue, or goodwill.

To the maximum extent permitted by law, our total liability for claims related to the Platform will not exceed the amounts you paid to Ajasa in the 12 months before the claim arose.

11. Indemnification

You agree to defend, indemnify, and hold harmless Ajasa, its affiliates, and personnel from claims, liabilities, losses, and expenses arising from your use of the Platform, your content, or your violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict of law principles, except where mandatory local law provides otherwise.

13. Changes to Terms

We may update these Terms from time to time. Updated Terms become effective when posted. Continued use of the Platform after updates means you accept the revised Terms.
